Are my employees entitled to sick pay?

Yes, employees in Ireland are entitled to Statutory Sick Pay (SSP). Currently, eligible employees are entitled to 5 days of SSP per year at 70% of their normal pay, up to a maximum of €110 a day.

Can I deduct my employees’ wages?

To deduct money from an employee’s wages, you should first ensure that there is a clause in the employee’s contract which allows for wage deductions in certain circumstances, or that a deduction has been agreed to in writing. There are also additional considerations to bear in mind if the employee is earning the national minimum wage.

Do part-time staff get paid for bank holidays?

Part-time staff receive public holiday entitlements if they’ve been employed with the business for at least 40 hours in the five weeks preceding the public holiday, or if the public holiday falls on a day that they are rostered to work. The specific entitlements also vary slightly from those for full-time staff.

Do temporary employees get holiday pay?

All employees, including temporary employees, are entitled to earn annual leave entitlements from their first day of employment. Leave entitlements can be calculated in a number of different ways, depending on how long the employee has been working.

Do I have to divide tips between my staff?

The Payment of Wages (Amendment) (Tips and Gratuities) Act 2022 introduced legal obligations for employers around sharing tips, gratuities and service charges. Among the multiple requirements laid out in the Act, this legislation states that employees are legally entitled to receive electronic tips and gratuities, and that they must be distributed in a fair manner.
